Common Questions About Civil Litigation

What is a civil litigation?

Civil litigation is a very broad term.  It includes landlord-tenant disputes, breach of contract, employment and wage claims, construction disputes, personal injury claims, workers compensation, education law.  Civil litigation is not criminal.  Criminal law involves the state prosecuting people for breaking laws. 

What does a civil attorney do?

 A civil litigation attorney represents the client through their dispute.  Some cases can be resolved without filing a lawsuit.  If that is not possible, the attorney will file the appropriate claim or complaint or defend the case by filing the proper pleadings.  There is a pre-trial period when the parties exchange information and the parties are deposed; this is called discovery.  When appropriate, motions will be presented to the court. Eventually, a case will make its way to mediation, arbitration, or trial.

Do you need a lawyer in a civil suit?

It is very rare that an unrepresented party will have a positive outcome.  An unrepresented party is expected to follow all the rules that attorneys follow and be able to present their case. 

Why should I hire a lawyer in a lawsuit?

Lawyers are trained and experienced in the law.  If you are sued, you and your assets may be at risk to money judgments.  If you have a claim, you want to make sure you are making the right claim.  Lawyers analyze the facts and know-how to prepare a case for negotiations, settlement, or trial.
